Welcome to Emirates Nature-WWF’s Website. Please take the time to read and understand the Terms and Conditions (“Terms”) prior to registering the website or using any portion of Emirates Nature-WWF’s website (“Site”) which consists of all content and pages located within www.leadersofchange.ae domain. These Terms are an agreement between you and Emirates Nature-WWF (“EN-WWF”).

These Terms apply to the entire contents of this website and any site owned or operated by us which is linked to this policy, to any downloaded or streamed content and to any correspondence between us and you. The Privacy Policy and Contact Us section also form part of these Terms and Conditions (together referred to as 'Terms') and should be read also.

Once you click “I Agree”, you agree to the Terms as a legally binding contract between you and EN-WWF.

Who we are
Emirates Nature Association is an Emirati civil society of public interest, decreed under the Ministry of Community development in the UAE, working in association with the WWF global network, which operates in over 100 countries around the world. All country offices work collaboratively with a common mission of creating a future where people and nature thrive. We are known as Emirates Nature – WWF (EN – WWF) to distinguish ourselves from our sister organizations from other countries. This privacy policy relates to the information which is obtained and processed by EN - WWF only.

In these Terms, whenever you see the words ‘we’, ‘us’ or ‘our’, it refers to our entity in totality.

Subscription to Services
In engaging with the website, you have the ability to subscribe, in which your subscription to Services (“Subscription”) to have access to our Services.
1. If you are under 18 years age, you will need your parent’s or legal guardian’s signed permission before subscribing to our Services and agreeing to our Terms. If you are considered a person of determination (POD), someone who has conditions, ailments physically or mentally in which you have been instated a legal guardian, you will need your legal guardian’s signed permission before subscribing to our Services and agreeing to our Terms.
  
  In the case that you are under 18 years of age and agree to the Terms, your parent or legal guardian will assume all responsibility set forth in the Terms. If you want to make use of certain facilities available through our websites or to carry out certain actions (such as registering to obtain a newsletter, receiving content, or contributing comments, amongst others) or engage in Services, you must first subscribe with us. During registration, you will be asked to provide an individual username and password which you will need to use each time you carry out the action which you registered for (e.g. each time you purchase a product or submit a contribution). We may change your username and password from time to time.
4. You must ensure that you keep your username and password confidential and that you do not disclose them to anyone, and that you also restrict access to your computer to prevent unauthorized access to your account. You will be responsible for all activities which occur under your username and password. It is your responsibility to immediately notify us of any unauthorized use of your username and password or any other breach of security as soon as you become aware of it.
5. By registering, you certify that all information you provide in the registration is accurate. Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering.
6. If you want to make use of certain facilities and Services available through our websites or to carry out certain actions, you must first subscribe with us. During Subscription, you will be asked to provide an individual username and password which you will need to use each time you carry out the action which you registered for (eg each time you purchase a product or submit a contribution). We may change your username and password from time to time.
7. You must ensure that you keep your username and password confidential and that you do not disclose them to anyone, and that you also restrict access to your computer to prevent unauthorized access to your account. You will be responsible for all activities which occur under your username and password. It is your responsibility to immediately notify us of any unauthorised use of your username and password or any other breach of security as soon as you become aware of it.
8. By subscribing, you certify that all information you provide in the registration is accurate. Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. Contributors to discussion websites must have a valid email registered with us at all times.
9. Your Subscription to Services is non-transferable. You must not share your username and password with anyone else or allow anyone else to access the Site using your username and password.
10. You are responsible for every use of the Site that occurs in conjunction with use of your username and password.
11. You must use reasonable efforts to keep your username and password confidential.
12. You must notify us as soon as you become aware of any unauthorized use of your Subscription, username or password.
13. Your Subscription, or access to Content and areas of the Site, will be suspended or cancelled if we do not receive the fees for your subscription type.
14. We may terminate your registration at any time at our complete discretion, but will generally only do so if you are in breach of website rules such as the Contribution Rules. If we terminate or suspend your registration you may not re-register with us without our written consent.
Payment of Services
1. Yearly Payment for Leaders of Change Subscription (‘Subscription’)
  Applies to the registration where payments are made every year for the duration of the Subscription.
  
  You understand and agree to that you have committed to a contract and agree to the Subscription fees payable by you at the rate offered at purchase time to access the Services for a period of 1 year.
2. Monthly Payment for Leaders of Change Subscription (‘Subscription’)
  Applies to registration where payments are made every month for the duration of the subscription. This is a yearly commitment paid monthly.
  
  You understand and agree to that you have committed to a contract and agree to the Subscription fees payable by you at the rate offered at purchase time to access the Services for a period of 12 months.
  1. Cancellation of Payment
    You understand that you can cancel your Subscription anytime. By cancelling your Subscription, you understand no refunds will apply.
    
    Silver monthly plans can be cancelled anytime during the year.
  2. Renewal of Subscription
    You will be notified via the email provided by you 1 month prior to your original registration date for an automatic renewal. If you do not wish to renew your Subscription, please contact +971 (4) 383-9305 or call helpline. You understand that if you do not contact the email [email protected] or helpline, clause 3.1.1 will apply.
3. Donations
  Donations made through this Site are complete and charitable gifts made by you to EN-WWF and are not refundable.
4. Payment for Other Services
  Applies to the payments that are made as a one-of purchase for any or one of the Other Service(s). You understand and agree that you have committed to a contract and agree to the payment fees payable by you at the rate offered at purchase time to access the Other Services.
  1. Cancellation of Payment
    You understand that you can cancel your booking (Booking) to any or one of the Other Service(s) only one week prior to the Other Service date of occurrence. By cancelling your Booking, you understand no refunds will apply; however, you will be issued a credit note for the same amount that will last only 6 months from the date of purchase and can be used to purchase one or any of the Other Service(s) offered by EN-WWF as listed above under Section 1 of the Terms.

Refusal, suspension or termination of subscription
We may, in our discretion, immediately restrict, suspend, or terminate your Subscription and access to the Site if we consider you in breach of these Terms, any other Site rules, or applicable law.

We reserve the sole right to refuse registration to our Services.
Rights to Content; Intellectual Property
Each item of Content is copyright of EN-WWF. We own any Content, and all other rights in the Site including its design, compilation and look and feel.

You must not distribute or redistribute Content such as and not limited to: photos, videos, any form of resources, tool kits, documents, marketing material, project files, and any and all relative content found on the Site.
1. You acknowledge that all copyright, trademarks and other intellectual property rights in the website and all photographs, designs, images, text, software, data, audio, video, files and other material in the website or material generated by or transmitted from the website ("EN-WWF Material") are owned by us or our licensors. You are permitted to use the website and EN-WWF Material only as expressly authorised by us.
2. Provided you use the website and EN-WWF Materials in accordance with these Terms you are permitted to print, download and receive extracts of EN-WWF Material ("Extracts") ONLY for your personal non-commercial use and for private study or teaching purposes, provided in each case that:-
  1. copyright and source indications are also printed and copied and/or stored in association with the Extracts;
  2. no modifications are made to the Extracts and Extracts are not used as part of any other publication or derivative work; and
  3. any Extract is retained, printed and/or copied entirely and is not used in a derogatory or misleading context and in particular may not be used for the purpose of promoting, advertising, endorsing or implying a connection with you (or any third party) and EN-WWF, its agents, employees or representatives.
3. The rights in term 5.2 are not transferable and no other use of EN-WWF Material may be made without first obtaining our written permission. In particular, you must not do the following unless you have first obtained our written permission:-
  1. incorporate any EN-WWF Material in any other work, broadcast or publication, whether in hard copy or electronic form; or
  2. make any commercial use or publish any EN-WWF Material (other than as necessary for the purpose of viewing or listening to the website in the course of business); or
  3. perform, broadcast or otherwise transmit, post, share or make available to the public any EN-WWF Material.
4. If you wish to use any EN-WWF Material other than in accordance with Terms 5.2 and above, please email your request to [email protected]
5. The photographic, text, graphic images, audio and video material within any products or publications supplied to you are copyright works and none of them may be copied, reproduced, licensed, broadcast, transmitted or otherwise exploited.
6. The EN-WWF name and logo are trademarks of EN-WWF. Other logos and names used on the website may also be the trademarks of EN-WWF or their respective owners. No permission is given by us in respect of the use of any such trademarks, names or logos and such use may constitute an infringement of the holder's rights.
7. Whilst we encourage our supporters to campaign on the issues referred to on our websites, please do not imply that you are taking action on behalf of EN-WWF and in particular do not state that EN-WWF is taking, or proposes or is considering taking, action against individuals or organisations.
8. Any rights not expressly granted in these terms are reserved.
9. We may terminate your rights to use or receive Extracts at any time at our complete discretion.
Contributions
1. All content posted or submitted by users of the website, including but not limited to, stories, comments, suggestions, and emails ('Contributions') must comply with the following. Please read the below carefully submitting any material to this website. If you share any Contributions, this will form part of the contract between you and us.
2. We are not responsible for Contributions posted to our websites. These Contributions express the views of the author of the Contribution, not the views of EN-WWF.
3. If you have a complaint about any content on this website, please contact us immediately. To consider your complaint we need your name, company name if relevant, contact details (both a land address, telephone number and email), details of the exact content complained of and details of why you are complaining about that content. Please note that no action can be taken without this information.
4. You must not post or transmit to this website any material:
  1. that is knowingly false or misleading
  2. that is defamatory, illegal, abusive, vulgar, hateful, harassing, liable to incite racial hatred, blasphemous, discriminatory, pornographic, sexually oriented, threatening or invasive of a person's privacy
  3. which you do not own or for which you have not obtained all necessary licenses and/or approvals
  4. which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data)
  5. impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with anyone or entity.
5. We shall be entitled to reveal your identity (or any information which we have about you) if appropriate and in accordance with data protection legislation.
6. You agree to indemnify, defend, and hold harmless EN-WWF and all its affiliates from and against all liabilities, claims, demands and expenses arising out of any of your Contributions which breach these Terms.
7. Any Contributions you transmit or post to this website shall be considered non-confidential. By transmitting or posting a Contribution to the website you:-
  1. represent that you are fully entitled to do so;
  2. grant us a non-exclusive, perpetual, non-terminable, worldwide, sublicensable and royalty-free license to copy, modify, distribute, show in public and create derivative works from that material in any form and anywhere for all commercial or non-commercial purposes related to our work; and
  3. authorise us to adapt the relevant material in the course of doing so and so waive all moral rights you have in your Contribution to the fullest extent permitted by law.
Privacy
Our information collection and use of any personal information about you is set out in our Data Protection & Privacy Policy

Personal information that you disclose may be used by EN-WWF, including marketing activities for the Site.

We may disclose any personal information as necessary to satisfy any law, regulation or government request.
Fair use and prohibited conduct
You are permitted to download Content to your computer as part of your purchase of service. But your purchase is subject to a ‘fair use’ policy. Our ‘fair use’ policy requires that your use of the Site and the Content must be fair, genuine and reasonable. For example, the total amount of Content you download must be reasonable and relevant to Services that you agree to participate and partake in. We will use our reasonable discretion to decide whether a member has complied with the ‘fair use’ policy.

You also must not:
1. use a false email address, impersonate others, or misrepresent your affiliation with others;
2. insert advertising, branding or other promotional content into the Site or Content;

Changes
We may change these Terms at any time, in which case the amended Terms will be posted on the website and will apply from the date we post them. Please check these Terms on each occasion you use the website. If you continue to use the website, you will be bound by the latest Terms. The format and content of the website changes constantly. You should refresh your browser each time you visit the website to ensure that you access the most up to date version.
Availability and use of the Site
The Site will usually be available 24 hours a day, seven days a week. We may, however, need to interrupt or suspend your access to the Site or the provision of the Site’s services and Content, for maintenance, technical or other reasons.

When accessing and using the Site and its services and Content, you must comply with directions, instructions or protocols posted on the Site.
Rules of engagement
We reserve the right, but are not obliged, to monitor all matter posted to the Site. We are not responsible or liable for material posted by others. We do, however, reserve the right to edit, refuse to post or to remove matter that in our discretion is objectionable or in violation of these Terms, our policies or applicable law. We reserve the right in our sole discretion to deny any user access to the website or any part of it without prior notice.
Rules of engagement
You agree to only use the website in a manner that complies with all applicable laws and regulations and is consistent with the Terms and does not infringe the rights of anyone else, nor restrict or inhibit their use and enjoyment of the website (including, without limitation, by hacking).

2. are false, misleading, fraudulent, unlawful, abusive, harassing, defamatory, obscene, vulgar, or offensive;

5. that is defamatory, illegal, abusive, vulgar, hateful, harassing, liable to incite racial hatred, blasphemous, discriminatory, pornographic, sexually oriented, threatening or invasive of a person's privacy
6. which you do not own or for which you have not obtained all necessary licenses and/or approvals
7. impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with anyone or entity.
Code of Conduct
By agreeing to the Terms, you agree to respect and uphold the values of EN-WWF and the values of the United Arab Emirates, which encompasses anything against the federal law, the state laws, culture, and traditions of any of the Emirates in which Services are conducted. If Services are conducted virtually, digitally or via the website, then, by default, the laws of the United Arab Emirates as applied in the courts of Abu Dhabi will apply.

In relation to the above:
1. You will dress modestly as to not offend any of the United Arab Emirate’s culture and traditions;
2. You will behave in a respectful manner towards your peers and the Parties;
3. You will not physically or verbally assault anyone under any circumstances;
4. You will not use any obscene, discriminatory and/or defamatory language; and
5. You will not post or circulate any imagery which could be deemed inappropriate;
Liability and Disclaimer
In consideration for being allowed to participate in this Service and/or Subscription, on behalf of yourself, your next of kin, your heirs and/or of your legally recognized or instated representatives, you release EN-WWF from all liability and promise and to not to take any legal action(s) against EN-WWF, their employees, officers, advisors, directors, upper management, volunteers, vendors, suppliers, third party entities, partners, stakeholders, sponsors, representatives and/or agents (collectively “Parties”) from any and all claims, including claims of:
1. negligence, resulting in any physical injury or ailment or any kind (including paralysis and death),
2. psychological and/or emotional distress or ailment of any kind
3. illness(es),
4. damage(s),
5. economic loss, and/or
6. emotional loss.
that you may suffer because of your participation to any Services as seen on the Site and referenced earlier in Terms, including travel to, from, during and post the Service at any period of time.

By agreeing to the Terms, you understand
1. that you are voluntarily participating in this Service;
2. that you are aware of the risks associated with traveling to/from and participating in this Service, which include but are not limited to physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and/or death;
3. that these injuries or outcomes may arise from your own or other’s actions, inaction, or negligence; conditions related to travel; or the condition of the Service location(s).
4. while participating, you may be photographed. You agree to allow your photo, video, or film likeness to be used for any legitimate purpose by the Subscription holders, producers, sponsors, organizers, and assigns;
5. That you certify that there are no health-related reasons or problems which preclude your participation in this Service;
6. You acknowledge that this activity may involve a test of a person's physical and mental limits and carries with it the potential for death, serious injury, and property loss. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, lack of hydration, and actions of other people including, but not limited to, participants, volunteers, monitors, and/or producers of the activity. These risks are not only inherent to participants, but are also present for EN-WWF’s Parties.
7. You have been informed of, understand and are aware that any Subscription, whether or not requiring the use of equipment, is a potentially hazardous activity.
8. That you have been informed of, understand and are aware that participating involves a risk of injury, as well as abnormal changes in blood pressure, fainting, and a remote risk of heart attack, stroke, other serious disability or death, and that you are voluntarily participating with your full knowledge, understanding and appreciation of the risks involved.
9. Any losses or damages to any or all of your personal belongings and possessions (such as our phone, vehicle, laptop, amongst others…); or
10. Any loss, disruption or damage to your computer system; or
11. Any other loss or damages whatsoever (including, but not limited to, loss of profit or loss of use, direct, indirect or incidental loss) arising out of your use or inability to use our websites (including downloading or streaming from the website), their content, any information on or from the websites or any link to another website and whether such loss or damage arises in contract (including negligence) or otherwise.
Therefore, you assume all related risks and responsibility, both known or unknown to you, of your participation in this Subscription, including travel to, from, during and post the Service at any period of time.

We do not necessarily control such websites and are not responsible for their contents. Advertisers and Sponsors
We may from time to time allow companies to advertise goods and services on our websites. While we will not knowingly run an advert that is untrue, or which relates to goods or services contrary to our objects, the appearance of an advert does not mean that we endorse the advertiser's goods or services. We are not responsible for the accuracy of any advertising material or for any advertised product or service.
Waiver
If you breach these Terms and we take no action, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these Terms.
Events Beyond our Control
We will not be liable to you for any delay in delivering any services or order or breach of our obligations, if the delay or breach is due to acts of God, civil commotion, riots, malicious damage, floods, drought, fire, legislation, failure of ISP or telecommunications provider or other cause beyond our reasonable control. This does not affect your statutory rights.
Governing Law
You agree that these Terms and any claim or dispute arising out of or relating to these Terms or any Content or Service obtained from or through the Site will be governed by the laws of Abu Dhabi, and where applicable, the federal laws of the United Arab Emirates. You agree that if any claims or disputes arise, they will be heard and resolved exclusively by the Courts of Abu Dhabi. You agree to the personal jurisdiction of those courts of you for this purpose and waive and agree not to assert any objection to such proceedings in those courts.
Entire Agreement
These Terms and the Data Protection and Privacy Policy constitute the entire agreement between you and EN-WWF with respect to your use of the Site.
